Welcome to Pique Innovations Inc. (DBA Construction AI). We are a Canadian company with virtual operations in the United States, offering a specialized file synchronization service tailored for the construction industry. Our Service integrates seamlessly with your Procore instance to streamline project data management (the "Service"). This Privacy Policy outlines how [Your Company Name] ("we," "us," or "our") collects, uses, processes, and discloses your information when you use our Service. Protecting your project data is our top priority, and we are committed to transparency in our data handling practices across both Canada and the United States.

2. Information We Process

When you connect our Service to your Procore account, we process the data necessary to provide our features. This primarily includes:

  • Construction Plan Data: Digital blueprints, plans, drawings, and related documents that you choose to process through our Service.

  • Procore Account Information: We access your Procore account with your permission via an API connection to read the necessary plan data and write the processed results back to your instance. We do not store your Procore login credentials.
    We only process data that you explicitly authorize our Service to access from your Procore account.

3. How We Use Your Information

We use the information we process for the sole purpose of providing and improving the Service. This includes:

  • Reading plan data from your Procore instance.

  • Analyzing and processing this data to provide the features of our Service.

  • Writing the processed data and results back into your Procore instance.
    We will not use your plan data for any other purpose, such as marketing or advertising, without your explicit consent.

4. Data Processing and Third-Party Services

To provide our Service, we rely on a few trusted third-party service providers ("Sub-processors"). We have carefully selected these providers and ensured they have strong privacy and security standards. Our key Sub-processors are:

  • Amazon Web Services (AWS): Our primary application and data infrastructure is hosted on AWS. To ensure data sovereignty for our Canadian clients, we exclusively use the AWS Canada (Central) region for our core infrastructure. For clients in the United States, we may also use AWS regions located in the US to optimize performance.

  • OpenAI, L.L.C.: To provide our advanced data analysis features, we send plan data to OpenAI's Application Programming Interface (API). OpenAI's policies for business users of their API state that they do not use customer data submitted via the API to train their models.

5. International Data transfers

As a Canadian company with operations in the United States, our core infrastructure is primarily located in Canada, but some data processing occurs in the US due to our use of OpenAI's API and, for US clients, AWS US regions.

  • Data processed by OpenAI is transferred to their infrastructure in the United States.

  • For clients in the United States, data may also be processed in AWS US regions to ensure optimal performance.

  • While your data is being processed in the United States, it is subject to the laws of that jurisdiction.

  • OpenAI temporarily retains API data for a maximum of 30 days for abuse and misuse monitoring, after which it is deleted. Our own infrastructure in Canada retains data for 90 days as described in Section 7.
    By using our Service, you acknowledge and consent to the necessary transfer and processing of your data in the United States by our sub-processors and, where applicable, our US-based infrastructure.

6. Data Security

We take the security of your data seriously. We use industry-standard technical and organizational measures to protect your information, including encryption in transit and at rest. We ensure that access to your data is strictly limited to the personnel and services necessary to provide the Service.

7. Data Retention

We believe in data minimization and only retain your data for as long as necessary. Our retention policies are as follows:

  • On our AWS Infrastructure: We retain a copy of the plan data we process for a period of 90 days. This retention period allows us to provide customer support, troubleshoot any processing issues, and maintain a short-term operational log. After 90 days, this data is automatically and permanently deleted from our systems.

  • With our Sub-processors: As noted above, data processed by our sub-processor, OpenAI, is retained on their systems for up to 30 days for their monitoring purposes.
    We do not have a permanent archive of your construction plan data. Your Procore instance remains the primary source of truth for your information.

8. Your Rights

As a Canadian company with operations in the United States, we operate in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable US data protection laws. You have the right to access the information we hold about you and to request corrections. As we primarily process data from your Procore instance, the most effective way to manage your data is within your Procore account.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any significant changes by posting the new policy on our website or through other communication channels.
